1. Introduction
These Terms and Conditions govern your use of the Mechanica Studio website at www.mechanicastudio.com and any purchase made through it. By placing an order with Mechanica Studio, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not place an order.
2. About Our Products
Mechanica Studio designs and manufactures bespoke concrete dipole loudspeaker systems in Johannesburg, South Africa. Each system is hand-cast and assembled to order. As a result, all orders are considered made-to-order and production begins upon receipt of payment.
3. Orders and Payment
3.1 All prices are listed in South African Rand (ZAR) and include VAT at the applicable rate.
3.2 Payment is processed securely through PayFast. By completing checkout, you authorise Mechanica Studio to charge the full order amount to your selected payment method.
3.3 Accepted payment methods include Visa, Mastercard, Apple Pay, and Google Pay.
3.4 An order is confirmed only once payment has been successfully processed and you have received a written confirmation from Mechanica Studio. We reserve the right to cancel or decline any order at our discretion, in which case a full refund will be issued.
3.5 International customers must contact us directly at info@mechanicastudio.com to arrange an order. International orders are not processed through the website checkout.
4. Lead Time and Shipping
4.1 Each system ships within 4–8 weeks of order confirmation. You will be advised of lead time upon placing your order and notified when your order has been dispatched.
4.2 Free delivery is included on all domestic (South Africa) orders. Delivery is to a ground-floor accessible address. White-glove or in-room placement services are not included unless separately arranged.
4.3 Each unit is custom-crated for transit. Please inspect all packaging on delivery and note any visible damage with the courier before signing. Mechanica Studio accepts no liability for damage caused during transit where the consignment was accepted without notation of damage.
4.4 For international orders, shipping, customs duties, import taxes, and related logistics costs are the sole responsibility of the customer unless otherwise agreed in writing.
5. Returns and Refunds
5.1 Made-to-Order Policy
Because every Mechanica Studio system is manufactured to order, we do not accept returns or offer refunds on the basis of change of mind, incorrect colour selection, or any reason other than a confirmed manufacturing defect. Sample colours can be arranged upon request.
5.2 Defective Components
All systems are fully tested prior to shipping. If a component arrives in a demonstrably defective condition — meaning it fails to function as specified under normal operating conditions — Mechanica Studio will replace the affected component at no charge to the customer. This applies to both domestic and international orders, and is applicable only to the specific part found to be defective.
To qualify:
- The defect must be reported in writing to info@mechanicastudio.com within 14 days of delivery.
- You must provide a written description of the fault and supporting photographic or video evidence.
- Mechanica Studio will assess the claim and respond within 5 business days.
- If the claim is approved, we will arrange replacement of the defective component. We do not offer cash refunds in lieu of replacement.
- For international orders, the customer is responsible for any shipping, customs duties, or import costs associated with the return of the defective component and delivery of its replacement, unless otherwise agreed in writing.
5.3 Exclusions
The following are not covered under our returns or defect replacement policy:
- Damage caused by incorrect amplifier matching, overdriving, or use outside the published specifications.
- Cosmetic variation inherent to hand-cast concrete (minor surface variation, tonal differences between baffles).
- Damage caused during transit where not noted at the time of delivery.
- Damage caused by modification, misuse, or third-party servicing.
6. Consumer Rights
Nothing in these Terms limits or excludes rights you may have under the Consumer Protection Act 68 of 2008 or any other applicable South African legislation. Where such legislation applies and cannot be excluded, it takes precedence over these Terms to the extent of any inconsistency.
7. Intellectual Property
All content on this website — including text, photography, product design, and branding — is the intellectual property of Mechanica Studio and may not be reproduced, distributed, or used without prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law, Mechanica Studio’s total liability to you in respect of any claim arising from your purchase shall not exceed the amount you paid for the relevant order. Mechanica Studio is not liable for any indirect, consequential, or special loss or damage.
9. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from them shall be subject to the jurisdiction of the South African courts.
